I understand the intent, but the discussion seems a little upside down
to me.
Each institution has the opportunity to cover these situations in the
contracts they negotiate with key people like head football coaches. If
they don't want their coaches to leave "early" or in other ways seek to
restrict the coaches ability to seek a new job, they have the ability to
build terms through incentives or penalties to do that.
At the same time, if my employer was seeking to limit my ability to seek
other employment, I'm certainly going to look for penalties to protect
me from early termination or other failures of the institution to
provide me the tools I need to be successful.
As far as timing, I've always thought it best for my employees who have
made a choice to go elsewhere, to do that quickly. So, in this
particular case, Cincy needs to move quickly to fill this vacancy and
the players have to move forward as well. Keeping a lame duck coach
around in an effort to sooth hurt feelings only delays this healing
process. It also introduces a whole set of other issues regarding
current staff, players, and recruits which are minimized by Kelly's
quick exit. Similarly, Kelly needs to get on with the job of being the
ND coach, assembling his staff, and recruiting the next class of ND
players. He can't do that in Cincinnati.

What really bothers me here is ND grabbing him now, and Kelly not
coaching the bowl game with his team--i.e., finishing the job (the
season). Let ND sacrifice a little on the recruiting end, and wait
patiently, so that Kelly can at least give Cincy a chance for an
undefeated, magical season. This way Cincy gets the raw end all
around, while the Domers get their cake and eat it. If they want to
grab a coach who is under contract, then they should have to yield
something in return. I think that the NCAA should adopt a rule that
says no poaching of any coach under contract until that coach has
concluded a season with his or her team (including post-season
tournaments and bowls). I know it would be somewhat difficult to work
and enforce, but it would give the student-athletes a better shake than
they now have and more parity with their coaches. They can't transfer
schools without sacrificing a year usually. Why should coaches have it
so much easier?
