You are correct as to whee the responsibility for protecting the public from pyschos lies but unfortunately, the politicians figured out the psychos don't vote so they spend our money on pork that will get them re-eleced.  The politicians aren't the only ones to blame.  The ACLU goes to court to get these people released and some dumb judge accommodates them.  Last year, a long time friend in Needham got murdured and his daughter in law nearly murdured by some guy who never should have been loose in the first place.
