IANAL, but my understanding of the rationale for DUI laws is thatthough you may be free to consume alcohol in your home or in alicensed establishment of your choosing, you do not have the right toendanger the lives of others by operating a motor vehicle under itsinfluence (though, so far as I know, you still have the right tovote); I'm guessing here, but I think the vast majority of you wouldagree that this arrangement makes sense.
It seems to me to be both illogical and ignorant to assume that allthose who use marijuana or advocate its decriminalization (the meritsof which aren't germane to this discussion) would tolerate drivingunder the influence of alcohol, marijuana, or any other impairingsubstance (BUCTAOE*), just as it would be illogical of me to assumethat you DUI (or tolerate others doing so) because you enjoy beer.
What is illegal is not necessarily immoral, and vice versa, as thoselawyers in the crowd can probably attest.
I am also not from NY, for the record.
