I think having the NCAA do this would be problematic.
I have wondered about the releasing of medical information regarding
players related to HIPAA. I remember when HIPAA first came out people were
very cagey on the sidelines talking about injuries, but that seemed to
become more loose over time.
I looked it up because I wondered how the NFL could have a rule regarding
releasing a players medical information. It is because the players signed
away their rights to confidentiality in the collective bargaining
agreement. So they are no longer covered by the law.
Without that type of a signing away of the player's rights to
confidentiality, it would be hard to mandate release of medical
information. The school may not be a "covered entity" by HIPAA standards,
but the treating clinician most definitely is. That would make things
really sticky.
