This is partially true. It depends on the state in which you reside. In Arizona (where I live) the maximum legal limit is .08, however you can (and many people often are) be charged with DUI while under the .08 if the police officer thinks you are impaired due to failure of a field sobriety test. I knew  a guy who was hit at a stop light (he was not moving) but he did have a couple beers. He failed the test, which is quite subjective, but BAC through blood draw was .06.

I have no idea what the law is in NE, but just relating the experience of someone I know.
