Good Evening:

In regard to the issue of the alleged Husker "fan" and his stupidity. 

In this type of a case, since it would be a civil case, you do not have to prove "beyond doubt" as you would in a criminal trial, you need only prove by preponderance of the evidence. 

This is what happened in the OJ Simpson situation, the attorneys were able to plant "doubt" in the minds of the jurors thus an aquital was reached in the criminal trial. In the civil case (of wrongful death) however the plaintiff (Fred Goldman et al) was able to win on the basis of a preponderance of the evidence. 

In this case I heard (or read) that one of the parents intends to prosecute to the fullest extent possible and to quote him here, "I have deep enough pockets to do it". 

What I cannot believe (and I would never have done this when I was in the broadcasting business) is that two radio stations (one in Houston, the other in Austin) ran with the story without verifying the information by either contacting either the Daily Oklahoman or the University of Oklahoma itself.
