And why would the NFL agree to such a disincentive? And why would the
players being drafted agree to such a disincentive?

Personally, I think a better option is to allow players who declare
for the draft, but who do not get an agent AND who do not get drafted,
the ability to return to their college team without losing any
eligibility.

There are three parties involved here. In no circumstance will we see
two of the parties agree to detrimental restrictions solely for the
benefit of the third.
