I am going to chime in on the issue of reporting medical information without
the families consent.
As a psychologist, I have some knowledge about the Healtcare Information
Privacy and Portability Act (HIPPA) and the right to privacy in medical
records.
Some on this list have debated that being a public figure diminishes their
personal right to the privacy of the medical records. That is an incorrect
assumption. Even public figures have the right to keep their healthcare
information private. They often choose to release or spin information to
control perception, but they control what is let out. A healthcare provider,
clinician or business, that releases info without permission is subject to
large fines.
In this case, if the hospital were to release information regarding Mr.
Lucky's admission, they could be subject to fines. Now, if a layperson
happened to be in the lobby and saw him come in, that is different.
The problem with not releasing information is that people are left to
speculate on what is going on, and often that can be worse than the truth.
Ultimately, when the family and Mr. Lucky are ready to discuss the
information, they will. Until then my heart and prayers go out to him and
his recovery.
